Terms and Conditions
QUOTATION, CONTRACT OR CONCLUSION OF THE CONTRACT:
- Please read the quotation and the General Terms and Conditions carefully, as lack of knowledge or misunderstanding of the quotation or the General Terms and Conditions cannot constitute grounds for a complaint.
- Partial or full payment of the amount stated in the quotation constitutes acceptance of the quotation and conclusion of the contract and is sufficient for the order to be released for processing.
- Cancellation of an order is only possible upon payment of the actual costs already incurred in processing the order and preparing the materials.
PRICES AND PAYMENT TERMS:
- The prices stated in the quotation are determined according to the supplier’s price list valid on the date the contract is concluded.
- Any additional work or materials required due to previously unforeseen conditions or circumstances will be handled separately and charged to the customer (e.g. the use of special lifting equipment or the discovery that the product cannot be installed using the originally planned fixing method).
- Final payment is due within seven days of completion of the service. A complaint or comment entered in the service report does not suspend the payment obligation. The goods remain the property of ROLTEK d.o.o. until payment has been made in full, including after installation.
PROVISIONS ON DELIVERY OF GOODS AND DELIVERY DELAYS:
- The delivery period begins on the date the order is confirmed, the final measurements are taken, or all order details (such as colour, drive side, etc.) are finally defined, and is 4–10 weeks.
- On the day of installation, the customer is responsible for ensuring access to the site and providing all conditions necessary for the installation or service work to be carried out.
ACCEPTANCE OF GOODS AND INVOICING:
- The goods are deemed to have been accepted by the customer when the supplier enables the customer to make actual use of the delivered goods or when the acceptance report is signed.
- Due to instability in the materials supply market, the delivery or installation date may be extended.
- Upon completion of the installation, the installer must provide the customer with a report confirming the installation or service performed. The customer must sign the report and may enter any comments.
- At the time of installation, the customer is required to verify that the order is complete.
- Upon completion of the installation, the installer will inspect the installation together with the customer and explain the operation and correct use of the shading systems.
- If the customer fails to take delivery of the goods within the specified period:
- the supplier reserves the right to charge storage fees amounting to 1% of the order value per day, starting 30 days after the expiry of the delivery period;
- the supplier is entitled to demand fulfilment of the quotation and/or charge storage costs amounting to 15% of the contract value for a maximum period of six months. After this period, the supplier has the right to deliver the goods to the customer’s address and charge any additional costs incurred. If this is not possible, the supplier has the right to dispose of the goods and retain the full payment.
- Before taking delivery, the customer undertakes to notify the supplier in writing of any change relating to invoicing, in particular any change of name, permanent or temporary address, company name or registered office, that could in any way affect the correct invoicing procedure stipulated in these Terms and Conditions. If the customer fails to fulfil this obligation and does not take delivery of the goods, or fails to do so on time, the supplier is entitled, after 45 days have elapsed from the notice requesting the customer to take delivery, to withdraw from the contract and freely dispose of the goods.
- The drive belt and belt winder are consumable items and are covered by a one (1) year warranty. The warranty does not apply to remote-control transmitters (remote controls).
- Manufacturing tolerances apply to the dimensions of the goods and depend on the dimensions ordered. Tolerances and certain specific requirements relating to the manufacture of insect screens are published on the ROLTEK website.
- Damage to a profile is considered a valid defect if it is visible from a distance of 3 m (300 cm) under normal lighting conditions when the product is not exposed to direct sunlight.
- In the event of force majeure, adverse weather conditions or conditions in which work is not legally permitted (e.g. frozen structures or strong winds), the installation may be suspended or postponed. A new installation date will be determined according to weather conditions.
- The customer is responsible for securing and protecting the windows of the building. If the customer fails to provide suitable access for installation (clear access routes, safe walking surfaces and cleared window sills, both inside and outside), the supplier shall not be liable for any damage resulting from the site not being properly prepared.
- If, on the day of installation, it is determined that the site has not been adequately prepared for the installation work, a new installation date will be arranged and charged according to the applicable price list.
- If the additional service of removing old materials is provided upon completion of the installation, such materials will be processed in accordance with the ISO 14001 standard and will not be stored.
- Following completion of the service, the invoice will be sent to the email address specified in the quotation.
